Agency Disclosure

Last updated: October 5, 2026

Minnesota law (Minn. Stat. § 82.67) requires real estate licensees to explain early on what type of agency representation or relationship they can offer you. This is a disclosure only, not a contract for representation.

Seller’s/Landlord’s Broker: represents the seller/landlord and owes the seller/landlord fiduciary duties. The broker must still disclose to buyers material facts that could adversely and significantly affect the buyer’s use or enjoyment of the property (Minn. Stat. § 82.68, subd. 3).

Buyer’s/Tenant’s Broker: represents the buyer/tenant under a written agreement and owes the buyer/tenant fiduciary duties, even if paid in whole or in part by the seller/landlord.

Dual Agency: occurs when one broker represents both parties to a transaction. It requires the informed written consent of all parties and limits the representation the broker can give to either party.

Facilitator: a broker who helps with a transaction without representing either party in a fiduciary capacity.

The fiduciary duties are Loyalty, Obedience, Disclosure, Confidentiality, Reasonable Care, and Accounting.

Predatory offender information: Information about the predatory offender registry under Minn. Stat. § 243.166 may be obtained from the local law enforcement office where the property is located, or from the Minnesota Department of Corrections at (651) 361-7200 or www.corr.state.mn.us.
